Who is an NRI?
An NRI is any citizen of India who is not residing in India and has resided in India for less than 182 days in the preceding financial year. NRIs have professional or other commitments which require them to live outside India for an indefinite period of time. However, NRIs still have opportunities to buy real estate in India.
Who is a PIO?
A Person of Indian Origin (PIO) is a person of Indian origin or ancestry who was or whose ancestors were born in India or other nations with Indian ancestry but is not a citizen of India.
Who is an OCI?
Overseas Citizenship of India (OCI) is a form of permanent residency available to people of Indian origin and their spouses which allows them to live and work in India indefinitely.
Who can purchase property in India?
Under the general permission granted by RBI, an NRI or a PIO/OCI can freely purchase immovable property in India.
What property can NRIs buy?
NRIs can purchase any residential or commercial property in India. However, they are not permitted to buy agricultural land, plantation property, or farmhouses without specific RBI approval.
What Documents Do NRIs Need for Purchasing Property?
NRIs need a valid Passport, Address proof (India and abroad), PAN card, Passport size photographs, and NRE/NRO bank account statements.
What are the steps for granting PoA?
The PoA must be drafted, signed by the NRI before a Notary Public or Indian Consulate in their country of residence, stamped, and then registered in India by the representative.
How is Capital Gain Tax calculated for NRIs?
Short-term capital gains (property held < 24 months) are taxed as per the NRI's income slab. Long-term capital gains are taxed at 20% with indexation benefits. A TDS of 20% (plus surcharge) is deducted by the buyer on the sale amount unless a lower TDS certificate is obtained.
Can income from rent be repatriated?
Yes, rental income can be freely repatriated abroad after the payment of applicable Indian taxes, subject to a limit of USD 1 million per financial year.
